Terms & Conditions of Trading
1) CARRIAGE TERMS AND MINIMUM ORDER VALUES
ENGLAND, WALES & SCOTLAND (EXCEPT OFFSHORE ISLANDS and Highlands) Minimum order value for New Accounts (first order) 48 units at £8.40 = £420 +VAT and will be delivered carriage free.
All orders under 48 Units at £420 will be surcharged £10 to cover administration and carriage. In addition expedient deliveries (when possible) will be surcharged 5% of the invoice value regardless of order size. For Northern and Southern Ireland, Isle of Man, Channel Islands, Scottish Islands, and Highlands, a minimum order value for New Accounts (first order) 48 units at £8.40 = £420 +VAT Delivery will be charged at Royal Mail prices., Pallet Force or equivalent. In addition; expedient deliveries (when possible) will be surcharged 5% of the invoice value regardless of order size.

3) PAYMENT TERMS
Initial orders for new accounts (non established accounts) will be strictly on a pro forma basis. Established accounts, once agreed in writing, will be on a strictly 30 days from the date of invoice. We reserve the right not to process orders if an account is outside our terms. We reserve the right to charge interest at 4% above the base rate of Barclays Bank plc, on overdue accounts, such interest being deemed to accrue on a day to day basis from the due date for payment. All cheques should be made payable to Loxfield Distribution Ltd and sent to Loxfield House, High Street, Buxted, East Sussex. TN22 4JU. In order to avoid postal delays, payment can be made directly to our Bankers. Please contact our accounts department online at firstname.lastname@example.org for our bank account details.
4) RETENTION OF TITLE
Title to the goods shall not pass to the Purchaser until the Purchaser has made full payment to the Seller of all the amounts owing to the Seller in respect of the goods and no other amounts then being outstanding from the Purchaser to the Seller in respect of the other goods supplied by the Seller.
5) NEW ACCOUNTS
Please allow 21 days for the credit application to be processed, and a further 10 weeks before delivery of large orders of £10,000 or more. If prompt delivery of your order is required, then this can be expedited by means of a pro forma payment, either by cheque (once cleared funds are shown in our account allow up to 5 working days), credit card (funds must be cleared in our account allow up to 4 working days) or bank transfer (funds must be cleared in our account allow up to 4 working days) Please note that only these items which are in stock and can be delivered at that time will be charged for.
6) DAMAGED AND SHORT DELIVERIES
Any damaged or shortages upon delivery must be reported within 24hrs or the next working day of receipt otherwise no liability will be accepted. Photographic evidence of damaged or faulty product or packaging must also be provided within 10 working days of delivery. In the absence of photographic evidence, the damaged or faulty goods or packaging must be retained for inspection by a Loxfield Distribution Ltd representative. Non delivery of goods must also be reported in writing within 10 working days of receipt of invoice. Please always quote our order number and your account number.
Goods should not be returned, and will not be accepted at our warehouse, without prior authorisation. All agreed returns must be sent to our warehouses (addresses available on request). To qualify for credit, all returned goods must be adequately packed and protected in a resalable condition. Please refer to our clauses 13 and 14 for details of any charges which may be incurred by returning goods.
8) PART SHIPMENTS
Every effort is made to send a complete order. However, we reserve the right to make part shipments due to external factors beyond our control.
9) CANCELLATION OF ORDERS
We reserve the right to cancel order balances of £100 and under. If you require a balance in excess of £100 to be cancelled, your notification must be made in writing. Please refer to our delivery conditions of any charges which may be incurred, should your notification be received after the goods have been packed or despatched. We reserve the right to carry over balances for goods.
We reserve the right to cancel orders which we are unable to purchase due to external factors beyond our control.
10) PRICES AND SPECIFICATION
Whilst endeavouring to maintain prices, we reserve the right to alter prices and/or specifications without notice. We also reserve the right to add a surcharge when necessary, and to vary order quantities to comply with pack quantities. All sizes and capacities quoted are approximate. Prices are reviewed annually and price lists are available on application.
11) CARRIAGE METHOD
Where possible, all consignments will be despatched on euro-pallets (120cm x 80cm), in pallet cartons unless specifically requested and agreed by Loxfield Distribution Ltd. Pallets will measure no more than 2m in height unless dimensions of the products being shipped prevent this.
We reserve the right to despatch smaller consignments in cartons if this is more economically viable.
12) DELIVERY RESTRICTIONS
It is the customer’s responsibility to advise Loxfield Distribution Ltd of any restriction that may affect the ability of our carrier to make a delivery. This includes dates and times, receiving capacity, specific equipments e.g. tail-lift vehicle, pedestrianised areas, road closures and any other issues which could contribute to difficulties in making a delivery.
13) SHIPMENT DATE
At the time of placing the order, you will be asked for a delivery date. Normally 10 weeks hence. No further communication regarding this date will be made by Loxfield Distribution Ltd. This date can be adjusted without charge up to 8 weeks before delivery is due. Thereafter the order will be in the hands of our 3rd party logistic provider, and it may be necessary to recover costs incurred as a result of any rescheduling or cancellation. If any alterations are made prior to the consignment being despatched, we reserve the right to make a restocking charge equal to 10% of the delivery value. If any alterations are made once a consignment has been despatched, this charge will increase by 25% of the delivery value.
14) DELIVERY ADDRESS
At the time of placing an order, you will be asked for a delivery address. No further communication regarding this address will be made by Loxfield Distribution Ltd. This address can be adjusted without charge prior to the consignment being despatched. Thereafter the order will be in the hands of our carrier, and it may be necessary to recover costs incurred as a result of any alteration to the delivery address. If any alterations are made to the delivery address after the consignment has been despatched, we reserve the right to make a rerouting charge equal to 10% of the delivery value.
15) MULTIPLE DELIVERY DATES
At the time of placing your orders, please ensure there is only one delivery date per order. We will consider an order as a potential single consignment, and subject to stock availability, We will despatch the maximum amount possible.
16) BOOKING IN DELIVERIES
Once our carrier has received an order they will contact you to arrange a suitable date for delivery within the following 10 days. If you are unable to provide a suitable acceptable date, the goods will be returned to our warehouse in East Sussex or Corby, Northants and a 25% restocking charge will be made. All single consignments should be accepted in one delivery. We reserve the right to make a 10% surcharge for split deliveries. Bookings will not be made for small parcel deliveries.
17) DATA PROTECTION
As Data Controllers under the Data Protection Act 1998, Loxfield Distribution Ltd is committed to protecting your privacy and all personal information supplied to us by you. Personal information is requested and collected to enable us to set up a customer account and to be able to correctly identify you, so that requested goods and services can be supplied. This information is collected by completion of our application forms; these will be kept in your customer file for future reference
The applicant confirms that the information given is correct and agrees to notify Loxfield Distribution Ltd in writing of any subsequent amendments. Failure to do so may result in credit being withdrawn.
Where we are unable to identify you from the information supplied, further details may be requested. This information may be passed to credit reference and fraud prevention agencies in order to supply credit facilities and to assist us when identifying you.
We do not pass your information onto other third parties, and by signing our application form you agree for your information to be used as detailed above. If you do not wish your information to be used in this way you can request this by e-mailing email@example.com, however, this may prevent us from being able to set a credit facility on your account.
We will check your details against those held with credit and fraud prevention agencies. If false or inaccurate information is provided and we suspect fraud, this will be recoded and other organisations may use and search these records.
Under the UK Data Protection Act 1998 we follow strict security procedures for the storage and disclosure of information, which you have given us to prevent any other unauthorised party accessing this data.
These Terms and Conditions were revised on 27th October 2014 and supersede all previous Terms and Conditions.
